1. Service Description

Triangle Trade Intelligence provides a tariff intelligence API and embeddable widget platform for developers, customs brokers, freight forwarders, and trade compliance professionals. The platform includes:

• A REST API with 53 v1 endpoints covering tariff rates, HS classification, duty calculations, compliance checks, and market intelligence across 9 countries
• 12 widget API endpoints powering embeddable trade intelligence tools
• 8 embeddable widgets (tariff calculator, HS classifier, USMCA qualification, Mexico ROI, CBP entry review, audit export, IEEPA refund estimator, trade policy alerts)
• Free public tools: Tariff Calculator and IEEPA Refund Estimator
• A developer portal for API key management, usage monitoring, and live endpoint testing

2. API Key Usage

API keys are issued per account and come in two types:

• Full API keys (tri_live_* / tri_test_*): Access to all 65 endpoints
• Widget keys (tri_widget_live_* / tri_widget_test_*): Widget endpoints only, domain-restricted

You agree that you will:

• Keep API keys confidential and not share them publicly (e.g., in client-side code, public repositories, or with third parties)
• Use API keys only for your own applications or authorized client applications
• Rotate keys immediately if you believe they have been compromised
• Not use test keys (tri_test_*) in production environments

3. Credits and Billing

The platform uses a credit-based pricing model:

• Free: $0/month, 100 credits, 10 requests/minute
• Starter: $49/month, 500 credits, 30 requests/minute, $0.05/overage credit
• Pro: $199/month, 3,000 credits, 60 requests/minute, $0.03/overage credit
• Business: $599/month, 12,000 credits, 150 requests/minute, $0.02/overage credit
• Enterprise: Custom pricing, 50,000+ credits, 300 requests/minute

• All tiers: Access to all 65 endpoints (all-access model)
• Billing: Monthly via Stripe. Credits reset at the start of each billing cycle
• Overages: Used beyond your monthly credit allowance are billed at your tier's overage rate. Free tier users are blocked at the limit
• Refunds: No refunds for unused credits within a billing period
• Cancellation: Cancel at any time; access continues until the end of your current billing period

4. Accuracy and Your Responsibility

By using the platform, you acknowledge that:

• The platform provides informational tools only, not legal or professional advice
• You are solely responsible for verifying tariff rates, HS classifications, and compliance determinations before using them in official filings
• You assume full liability for customs audit outcomes, penalties, or duties arising from your use of platform data
• You will consult licensed customs brokers or trade attorneys for official compliance determinations when required
• AI-generated HS classifications are starting points for analysis, not final customs determinations

5. Customs Broker Separation and Entry Document Restrictions

By using the platform, you acknowledge and agree that:

• Platform outputs (HS classifications, duty calculations, tariff rates, compliance assessments) are research and intelligence tools, not customs determinations
• You will not use API output to directly populate customs entry documents (CBP Form 7501, ACE entry summaries, or any document filed with U.S. Customs and Border Protection) without independent review and verification by a licensed customs broker
• A licensed customs broker must independently review and approve any HS classification before it appears on a customs entry, regardless of the confidence score or GRI reasoning provided by the platform
• The platform operates separately from any customs entry portal or filing system. There is no technical pathway where platform output flows directly into an entry document
• If you integrate the API into a customs or trade compliance application, you must maintain the same broker-in-the-loop separation: API output must pass through a licensed customs broker's review before it reaches any entry document or CBP filing
• Developers building on the API must display the platform disclaimer to end users and must not present API outputs as final customs determinations

This separation aligns with CBP guidance on permissible use of AI classification tools (19 USC § 1641; 19 CFR Part 111). The platform provides intelligence to support classification decisions. The broker makes the filing decision.

6. Prohibited Uses

You may NOT:

• Directly populate customs entry documents (CBP Form 7501, ACE entries, or equivalent) with platform output without licensed customs broker review
• Build automated filing pipelines that transmit API classification output directly to CBP or any customs authority without human broker review
• Represent platform output as official customs determinations to importers, exporters, or regulatory bodies
• Reverse engineer, decompile, or attempt to extract the platform's AI classification methodology or proprietary algorithms
• Scrape, bulk download, or systematically extract database contents (tariff rates, HS descriptions, policy data)
• Resell or sublicense API access to third parties without a written partnership agreement
• Exceed rate limits through credential rotation, multiple accounts, or other circumvention methods
• Use the API to build a competing tariff intelligence data product or API service
• Submit false, fraudulent, or misleading data through the platform
• Use the platform for any purpose that violates U.S. export control laws, trade sanctions, or applicable regulations
• Share API keys across organizations or use a single account for multiple unaffiliated businesses

7. Intellectual Property

What Triangle Trade Intelligence owns:

• AI classification methodology, prompts, and reasoning logic
• Database enrichment layers (policy overlays, volatility tiers, exclusion mappings, stacking rules)
• Widget source code, design system, and embed framework
• Platform UI, developer portal, and all proprietary software
• API response formats, schema design, and endpoint architecture

What you own:

• Your application code and integrations built on the API
• Data you submit (product descriptions, HS codes, trade scenarios)
• Analysis outputs you generate and store in your own systems

Public domain: Base HS codes and USITC tariff schedules are public domain. Our enrichment of that data is proprietary.

8. Widget Embedding

Widget keys are domain-restricted. When embedding widgets on third-party sites, you agree that:

• You will only embed widgets on domains registered to your account
• You will not modify widget JavaScript to bypass credit metering or domain restrictions
• Widgets may not be embedded on sites that promote illegal activity or violate trade sanctions
• End users of your embedded widgets are subject to the same accuracy disclaimer in Section 4

9. Service Availability and Changes

• The platform is provided "AS IS" without uptime guarantees on Free or Starter tiers
• We reserve the right to modify, deprecate, or remove API endpoints with reasonable notice
• Breaking changes to v1 API endpoints will be announced at least 30 days in advance
• Tariff data is updated as policy changes occur; we do not guarantee real-time synchronization with every USTR or CBP update

10. Data Retention

• API request logs: Retained for 90 days for usage monitoring and billing
• Account data: Retained while your account is active
• Usage analytics: Aggregated and anonymized for platform improvement
• Account deletion: You may delete your account at any time; personal data is removed within 30 days except where retention is required by law

11. Limitation of Liability

Triangle Trade Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Customs penalties, duties, or audit outcomes based on platform outputs
• Business losses resulting from tariff rate changes not reflected in the platform
• Service interruptions, data loss, or API downtime
• Errors in AI-generated HS classifications

Our total liability to you for any claim arising from use of the platform shall not exceed the fees you paid in the 3 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate API access if you violate these Terms, exceed usage limits in ways that indicate abuse, or engage in activity that could harm the platform or other users. You may cancel your account at any time from the subscription page. Upon termination, API keys are deactivated immediately.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. We will notify users of material changes via email at least 14 days before they take effect.

14. Governing Law

These Terms are governed by the federal laws of Canada and the laws of the Province of Ontario applicable therein. Any disputes shall be resolved in the courts of the Province of Ontario, Canada.
